In a case involving fraud, the outcome for creditors and investors may hinge on whether the company is a debtor whose case is guided by the Bankruptcy Code or under a federal equity receivership where equity is the guiding principle. Learn the differences between the two and how to guide your corporate client or trustee through parallel criminal proceedings, including responding to grand jury subpoenas, communicating with investigators, and when to waive the attorney-client privilege.
