Ninth Circuit Judicial Conference Lawyer Representatives

The United States District Court, Central District of California, is currently accepting applications from qualified individuals interested in serving as Ninth Circuit Judicial Conference Lawyer Representatives.  The selected Lawyer Representatives will be representative of the entire district and reflect the diversity of lawyers practicing before the Court.


Interested persons should complete the application, which can be found on the Court's website under the Lawyer Representatives section located in the "Attorneys" tab of the Court's homepage.  Additional information about serving as a Lawyer Representative can be found on the 9th Circuit's website at www.ce9.uscourts.gov/lawyer_reps/.

Relocation of Judge Bluebond's and Judge Saltzman's courtrooms and chambers

On August 22, 2016, Chief Judge Sheri Bluebond moved from courtroom 1475 and chambers 1482 on the 14th floor to courtroom 1539 and chambers 1534 on the 15th floor of the Roybal Federal Building and Courthouse. Telephone numbers for Chief Judge Bluebond's chambers have not changed.

On November 3, 2016, Judge Deborah J. Saltzman moved from courtroom 1339 and chambers 1334 on the 13th floor to courtroom 1639 and chambers 1634 on the 16th floor of the Roybal Federal Building and Courthouse. Telephone numbers for Judge Saltzman's chambers have not changed.

News from the Supreme Court

On January 14, 2015, the Supreme Court held oral arguments in Wellness International Network v. Sharif. Click HERE for the transcript.  Click HERE for the decision, in which the Supreme Court held that Article III permits bankruptcy judges to adjudicate Stern claims with the parties' knowing and voluntary consent.

On February 25, 2015, the Supreme Court held oral arguments in Baker Botts v. ASARCO. Click HERE for the transcript.  Click HERE for the decision, in which the Supreme Court held that the Bankruptcy Code does not authorize bankruptcy courts to award professionals the fees incurred by them for defending their fee applications.

On March 24, 2015, the Supreme Court held oral arguments in Bank of America v. Caulkett.  The question was whether, under Section 506(d) of the Code, a chapter 7 debtor may "strip off" a wholly unsecured junior mortgage lien.  Click HERE for the transcript.  Click HERE for the decision, in which the Supreme Court ruled that such a lien may not be stripped from the property.

On April 1, 2015, the Supreme Court held oral argument in Harris v. Viegelahn.  The question was:  When a debtor in good faith converts a bankruptcy case from chapter 13 to chapter 7, are the undistributed funds held by the chapter 13 trustee refunded to the debtor or distributed to the creditors?  Click HERE for the transcript.  Click HERE for the decision, in which the Supreme Court ruled that the funds must be refunded to the debtor.

Also on April 1, 2015, the Supreme Court held oral argument in Bullard v. Hyde Park Savings.  The question was:  Is an order denying confirmation of a bankruptcy plan appealable?  Click HERE for the transcript.  Click HERE for the decision, in which the Supreme Court ruled that such an order is not a final order and therefore is not appealable as a matter of right.

Clerk's Office Divisional Closures on Friday, December 12, 2014

The U.S. Bankruptcy Court for the Central District of California has announced that the clerk's office in the Santa Ana, San Fernando Valley, and Northern Divisions will be closed on Friday, December 12, 2014, to enable staff to attend a district-wide training program.

The intake section for the clerk's office at the Los Angeles division will be open for non-electronic filings for all divisions.

A small number of staff will be available at the Riverside division to accept emergency matters only for filers unable to travel to the L.A. division.

Revisions to the Federal Rules of Bankruptcy Procedure effective December 1, 2014

Revisions to the Federal Rules of Bankruptcy Procedure went into effect on December 1, 2014.  Revisions have been made to Rules 1014, 7004, 7008, 7054, 8001-8028, 9023 and 9024.

Notice from Office of the U.S. Trustee

From the Office of the United States Trustee:

Effective October 1, 2014, all chapter 11 cases filed in the Central District of California will be subject to revised "Guidelines and Requirements for Chapter 11 Debtors in Possession."

The revised guidelines may be found by clicking HERE.  Principal changes include, but are not limited to, the following:

-- All offices within the Central District of California will use the same procedures and forms.

-- A revised "7-day" package.

-- A new web mailbox for submission of 7-day package materials:  ustp.region16.ch11@usdoj.gov.

-- Electronic rejection of 7-day packages bearing incomplete and/or incorrect case names and numbers.

Request for comments on proposed amendments to the local bankruptcy rules

The Bankruptcy Court has proposed amendments to its local bankruptcy rules, to become effective January 5, 2015, and is circulating the proposals to the bar and public for comment.  A redline of the proposed amendments is available on the Court's website (www.cacb.uscourts.gov) under Rules.

Comments on the proposed amendments should be provided as soon as possible, but no later than October 8, 2014.

Comments must be submitted by email to bkcomments@cacb.uscourts.gov and include the name, email address and phone number of the person submitting the comments.

Reappointment of Judge Barry Russell

On August 25, 2014, the Ninth Circuit announced the reappointment of Judge Barry Russell.

Judge Russell is currently the longest-serving full-time bankruptcy judge in the nation with almost 40 years of continuous service to the U.S. Bankruptcy Court for the Central District of California in Los Angeles.  His reappointment to a new 14-year term will be
effective August 27, 2014.

Reassignment of Judge Saltzman's cases to Judge Yun

Effective July 21, 2014, virtually all of Judge Saltzman's Riverside cases and adversary proceedings will be reassigned to Judge Yun. Also, Judge Wayne Johnson has relocated from courtroom 302 to courtroom 304. Click HERE for the Court's public notice.

Appointment of Scott H. Yun

On June 20, 2014, the Ninth Circuit announced the appointment of Scott H. Yun to serve as a judge of the U.S. Bankruptcy Court for the Central District of California.  Judge Yun will serve in the bankruptcy court's Riverside division, filling a position left vacant by the transfer of Judge Deborah J. Saltzman to Los Angeles.

In memoriam: Arthur M. Greenwald

Arthur M. Greenwald died after a long illness on June 4, 2014.

Judge Greenwald was appointed to the bankruptcy court on March 9, 1988. He was reappointed on March 9, 1992, and was serving in the Woodland Hills Division at the time of his retirement on May 31, 2005. He received a degree in business from the University of California, Los Angeles and his law degree from Southwestern University School of Law. He was admitted to the California Bar in 1964, and served as an Assistant U.S. Attorney for approximately 7 years before his appointment to the bench.

Services will be held at Mount Sinai Hollywood Hills, 5950 Forest Lawn Drive, Los Angeles, CA at 10:00 a.m. on Monday, June 9, 2014.

Transfer and Reassignment of Cases and Changes in Zip Code-Defined Jurisdictions - Effective May 10, 2014

The Court has issued a Public Notice regarding (a) the relocation of Judge Peter Carroll to the Northern Division, (b) the relocation of Judge Saltzman to the Los Angeles Division, (c) the reassignment of Judge Carroll's Los Angeles Division cases to Judge Saltzman, and (d) the reassignment of Judge Saltzman's Chapter 7 and 11 Riverside cases to Judges Jury, Johnson and Houle.

In addition, zip codes for the cities of Simi Valley, Thousand Oaks, Westlake Village, Newbury Park, and Malibu, previously used to determine case filings assignments for the San Fernando Valley Division, are reassigned to the Northern Division, regardless of whether cities or zip codes are in Los Angeles County or Ventura County.  The zip codes include: 90263, 90264, 90265, 91319, 91320, 91358, 91359, 91360, 91361, 91362, 93062, 93063, 93064, 93065, 93094, and 93099.  All new bankruptcy cases for debtors in these cities and zip codes will be filed at the Northern Division.  Pending bankruptcy cases and reopened cases will remain in their original filing jurisdiction.

The Bankruptcy Court has announced that the current term of the Honorable Sheri Bluebond, U.S. Bankruptcy Judge for the Central District of California, is due to expire in January 2015. The U.S. Court of Appeals for the Ninth Circuit is considering the reappointment of Judge Bluebond to a new term of office of 14 years. The Court invites comments from the bar and public about Judge Bluebond's performance as a Bankruptcy Judge. Formation of Bar Rules Advisory Group to Focus on Forms for Individual Chapter 11 Cases

The Bankruptcy Court's Rules Committee has called for the formation of a Bar Rules Advisory Group that will complete a thorough review of the Court's forms for individual Chapter 11 cases (LBR F2081-1 forms series) and provide recommendations for improvement.  The advisory group will be comprised of volunteer attorneys that represent debtors and creditors in these cases.

To volunteer on the Bar Rules Advisory Group, attorneys are asked to send an email to Marty Bracciotti at Marty_Bracciotti@cacb.uscourts.gov with the following information:

  • Name of attorney and related firm
  • Attorney's email address, and phone number
  • Name of affiliated bar association (e.g., Los Angeles Bankruptcy Forum)
  • Court division(s) where attorney practices
  • Type of individual chapter 11 case practice (e.g., debtors, creditors, etc.)

Bar Rules Advisory Group members will be notified by March 5, 2014, and will meet in person at the Los Angeles Division.  Final recommendations for revisions to these forms are due by the end of June 2014.

Revisions to Local Bankruptcy Rules and Court Manual effective January 2, 2014

The Bankruptcy Court has announced revisions to the Local Bankruptcy Rules and the Court Manual that become effective January 2, 2014.

Of particular note, the requirement that proposed orders include a Notice of Entered Order and Service List will be eliminated. This revision was made because the Bankruptcy Noticing Center and CM/ECF have been serving all entered orders for one year, and a docket entry titled "BNC Certificate of Notice" specifies who was served, how they were served, and includes a copy of the served document.  Any additional service of the entered order will continue to be the responsibility of the party who lodged the order.

Relocation of U.S. Trustee's L.A. and Woodland Hills offices in mid-January 2014

Relocation of Los Angeles Office
The Office of the United States Trustee currently located at 725 S. Figueroa Street, 26th Floor, in Los Angeles will be closed to the public on January 9 and 10, 2014.  On January 13, the office will reopen at its new address:

The last 341(a) meetings will be held at the current location on January 9.  Meetings will resume on January 14 on the 10th floor of the new location.

Relocation of Woodland Hills Office
The Office of the United States Trustee currently located at 21051 Warner Center Lane, Suite 115, in Woodland Hills will be closed to the public on January 8, 9 and 10, 2014.  On January 13, the office will reopen at the same Wilshire Boulevard address to which the Los Angeles office is moving.

Woodland Hills 341(a) meetings will continue to be conducted at their current location until further notice.

Changes to Federal Court Miscellaneous Fee Schedule Effective December 1, 2013

The Bankruptcy Court has announced changes to the miscellaneous fee schedules that relate to bankruptcy cases, effective December 1, 2013.  Note that there will be a new $176 fee for the filing of motions for the sale of property free and clear of liens.  We have been advised by the Clerk that, at this time, this fee may not be deferred by trustees and other estate representatives.
